These Terms of Service ("Terms") govern your use of FineNote ("the App"), developed and published by FinePocket ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
FineNote is a free, offline markdown note-taking app for iPhone. All notes are stored locally on your device using Apple's SwiftData framework. The App does not require an account, does not connect to any remote server, and does not sync your notes to the cloud. FineNote is offered free of charge, with no in-app purchases, subscriptions, or advertising.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use FineNote on Apple devices that you own or control, solely for your own personal, non-commercial use, and in accordance with Apple's Media Services Terms and the App Store's usage rules.
All rights, title, and interest in and to the App (excluding the content you create within it) — including its design, code, and typography system — remain the exclusive property of FinePocket. This license does not grant you any rights to our trademarks, logos, or brand assets.
Notes you write in FineNote ("Your Content") remain entirely yours. Your Content is stored only on your device and is never transmitted to us or to any third party — we have no access to it, no copy of it, and no ability to view, recover, or restore it.
You agree to use FineNote only for lawful purposes. You agree not to:
FineNote is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the App will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the App will meet your requirements. You use the App entirely at your own risk, including the risk of data loss described in Section 3.
To the maximum extent permitted by applicable law, in no event shall FinePocket, its owner, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, loss of use, or loss of profits, arising out of or in connection with your use of, or inability to use, the App, even if we have been advised of the possibility of such damages.
Because FineNote is offered free of charge and stores data only on your device with no server-side backup, our total aggregate liability for any claim arising from these Terms or your use of the App shall not exceed USD 0 (zero), reflecting that no payment was made for the App.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including certain rights of consumers under the laws of the Republic of Korea.
Your use of FineNote is also subject to Apple's Licensed Application End User License Agreement and the App Store Terms of Service. In the event of a conflict between these Terms and Apple's terms regarding Apple's role as a third-party beneficiary, Apple's terms shall govern that specific relationship.
We may update, modify, or discontinue the App, or any part of it, at any time. We may also revise these Terms from time to time. If we make material changes, we will notify you through an in-app notice or an App Store update. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
You may stop using FineNote at any time by deleting the App from your device, which also removes all locally stored notes. We may suspend or discontinue the App (including removing it from the App Store) at our discretion, without liability to you, since no account or paid service is involved.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the competent courts of the Republic of Korea, unless mandatory consumer-protection law in your country of residence provides otherwise.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
